Information We Collect

We collect the information you choose to give us and a small amount of technical data when you use our site.

• Contact details, such as your name, company, email address, phone number and WhatsApp number.
• Deal and business information you submit, such as financing requests, property and project details, financial statements and other documents.
• Messages you send us by email, phone, our website forms or WhatsApp.
• Basic technical data, such as browser type, pages visited and approximate location, collected through privacy friendly site analytics.

How We Use It

• To review, underwrite and fund your financing request.
• To reply to you and keep you updated on your request.
• To send you our deal form and a reminder if you asked us to contact you.
• To prepare documents such as NDAs, terms and engagement agreements, and collect e-signatures.
• To run, secure and improve our website and services.
• To meet our legal, regulatory and record keeping obligations.

We may use automated tools, including AI, to read documents you send and organize deal information. A member of our team reviews every lending decision.

WhatsApp Messages

If you message us on WhatsApp, or someone introduces you to us there, we receive your WhatsApp name, number and the messages you send. WhatsApp is provided by Meta, and its own privacy policy also applies to your use of WhatsApp.

We use your WhatsApp number only to talk with you about your financing request. We send our deal form, one reminder if you have not completed it, and replies from our team. We do not send unrelated marketing on WhatsApp.

Reply STOP at any time to stop all WhatsApp messages from us. Reply START to turn them back on.

When We Share Information

We do not sell your personal information. We share it only as needed to serve you:

• With our capital and investor partners, to evaluate and fund your request, under confidentiality obligations.
• With service providers who help us run our business, such as website hosting, data storage, email delivery, e-signature and messaging. They may use it only to provide those services to us.
• With professional advisers, such as lawyers and accountants.
• When required by law, or to protect our rights, our clients or others.
• If our business is merged, sold or reorganized, subject to this policy.

How Long We Keep It

We keep information for as long as we need it to work with you, and afterwards as long as required for legal, tax, regulatory and record keeping purposes. We then delete it or make it anonymous.

Security

We use encryption in transit, access controls and limited staff access to protect your information. No system is perfectly secure, so please send sensitive documents only through our forms or secure links, not in group chats.

Your Choices and Rights

You can ask us to access, correct or delete your personal information, or to stop contacting you. Depending on where you live, such as Colorado, California or Canada, you may have additional rights under local law. We will not treat you differently for using them.

Deleting Your Data

To delete your information, including your WhatsApp messages, email info@bendercareycap.com from the address or number you used with us and write "Delete my data". We will confirm within 30 days. We may keep records we are legally required to hold, and will tell you if so.

Children

Our services are for businesses and adults. We do not knowingly collect information from anyone under 18.

Changes to This Policy

We may update this policy. The effective date at the top shows when it last changed.
